Serbia: New Rulebooks for Electronic Communications and Radio Frequency Spectrum

The Regulatory Authority for Electronic Communications and Postal Services in Serbia has introduced two new rulebooks aimed at enhancing the management and security of electronic communication networks and radio frequency spectrum. These regulations were officially published on November 7, 2024, in the “Official Gazette of RS” and came into effect on November 15, 2024.

Security and Integrity of Communication Networks

The Rulebook on the Security and Integrity of Electronic Communication Networks and Services and Terminal Equipment will be implemented starting December 1, 2025. Its key provisions include: 

  • Technical and Organizational Measures: Requires measures tailored to existing risks to safeguard users and interconnected networks. 
  • Incident Prevention and Response: Mandates steps to minimize the impact of security incidents on users and networks. 
  • Continuity of Operations: Introduces protocols to ensure the uninterrupted operation of public communication networks and services. 
  • User Protection: Details protective measures to prevent unauthorized use of terminal equipment providing internet access. 
  • Risk Alerts: Establishes a procedure for alerting users about specific risks to the security or integrity of public networks. 
  • Incident Reporting: Requires businesses to notify the authority of any security breaches significantly affecting their operations. 

Management of the Radio Frequency Spectrum

The Rulebook on the Requirements for Allocation and Use of Radio Frequency Spectrum Under General Authorization Regime outlines the rules for accessing and utilizing the RF spectrum in Serbia. Key highlights include: 

  • Authorization Requirements: Specifies the conditions under which radio frequency bands can be used under a general authorization regime. 
  • Record-Keeping: Introduces the requirement to document specific types of radio stations operating within authorized frequency bands.
