Malaysia: Updates to IP Forms for Type Approval

The Malaysia SIRIM CMCS Department, responsible for MCMC certification, has announced updates to the Intellectual Property (IP) forms, effective January 1, 2025. These changes address stakeholder concerns in the communications and hybrid industries.

Changes to the Form

A new declaration option has been introduced for applicants who cannot obtain written consent from the IP owner to use their trademark or brand. Additionally, an IP Infringement Disclaimer has been added, requiring applicants to acknowledge responsibility for any IP violations. 

Categories of Applicants and Required Documents

Applicants will fall under one of two categories: 

Category 1: The applicant has been authorized by the trademark or brand name owner. 

Required Documents: 

  • Evidence of registration certificate issued by the Intellectual Property Corporation of Malaysia (MyIPO) or an equivalent foreign organization. 
  • Intellectual Property (IP) Authorization Letter (eTAC/FOR/01-9 Issue:1, Rev:.1). 

Category 2: The applicant did not obtain written consent and authorization to use the trademark/brand. 

Required Document: 

  • Intellectual Property (IP) Undertaking form issued by the applicant (eTAC/FOR/01-8 Issue:1, Rev:.1). 

Forms Availability and Implementation

The updated forms will be required starting January 1, 2025. While the current forms remain valid until December 31, 2024, applicants are strongly encouraged to use the updated forms for any type approval application submissions to ensure a smooth process.
