India: Streamlines Telecom Licensing and Wireless Equipment Approvals

The Department of Telecommunications (DoT) in India has introduced significant reforms to simplify telecom licensing processes and speed up wireless equipment approvals. These changes aim to foster innovation, reduce regulatory delays, and create a more business-friendly environment in India’s telecom sector.

Faster Approvals for Experimental and Demonstration Licenses

For Experimental Licenses (Radiating Category), fixed timelines are now in place to ensure quicker approvals. If an application does not require Inter-Ministerial Consultation, it will be automatically approved after 30 days if no decision is communicated. In cases requiring consultation, provisional licenses will be issued after 60 days, and regular licenses granted after 90 days, provided there are no negative comments. 

Similarly, Demonstration Licenses (Radiating Category) will follow shortened timelines. Licenses not requiring consultation will be deemed approved after 15 days, while those needing consultation will be approved after 45 days. Applicants must submit an agreement that they will halt operations if any unfavorable comments arise during the provisional phase. 

Self-Declaration for Equipment Type Approvals (ETA)

A key development for wireless equipment manufacturers is the introduction of self-declaration for Equipment Type Approvals (ETA). Under the new process, companies can obtain ETA certificates by submitting applications through the SARAL Sanchar portal. This shift is expected to greatly reduce the time required to bring new wireless devices to the Indian market. 

Despite the simplified approval process, ETA holders must still ensure they meet compliance requirements. For instance, importing wireless equipment will require a No Objection Certificate (NOC) from the Directorate General of Foreign Trade (DGFT). 

These reforms, based on recommendations from the Telecom Regulatory Authority of India (TRAI), represent a significant step in enhancing ease of business in India’s telecom sector, providing faster, more efficient processes without compromising regulatory oversight.
