The Bureau of Indian Standards (BIS) has issued an amendment, dated February 25, 2026, to the BIS (Conformity Assessment) Regulations, 2018, updating the validity and continuation-of-operation provisions for licenses to use the Standard Mark under Scheme-II. The amendment clarifies the initial license term, renewal period, and annual fee payment obligations for licensees. BIS has also outlined the consequences for licensees who fail to meet annual payment and reporting deadlines. The update affects manufacturers and certificate holders relying on Scheme-II licensing to access the Indian market.

Key Changes to BIS Scheme-II Standard Mark Licensing

Under the amended regulations, a license to use the Standard Mark is granted initially for a period of five years, with applicable fees payable on an annual basis throughout that term. Upon expiry, licensees may apply for renewal, which is similarly granted for a further five-year period, again with fees due annually. This structure replaces prior ambiguity around license duration by establishing a consistent five-year cycle for both initial grant and renewal under Scheme-II.

Annual Fee Payment and Renewal Requirements Under BIS Regulations

Fees applicable to the grant, renewal, and continuation of operation of a Scheme-II license must be paid annually in advance, by the due date prescribed by BIS. Licensees are also required to submit production details alongside their annual fee payment. This recurring compliance obligation applies for the full duration of the license, including during renewal periods, making timely administrative follow-through a continuing requirement rather than a one-time certification event.

Consequences of Non-Compliance: Suspension and Cancellation Provisions

If the annual fee and accompanying production details are not received by the prescribed due date, the license becomes subject to suspension or deferment, and may ultimately face cancellation or expiry in accordance with the BIS (Conformity Assessment) Regulations, 2018, as amended. BIS has specifically advised applicants and existing licensees to ensure timely payment of annual fees and submission of production details to avoid disruption to their certification status.
