Eswatini: Updated Guidelines on License-Exempt Spectrum Usage

The Eswatini Communications Commission (ECC) has issued Notice 10/2024 for new guidelines focused on the use of license-exempt spectrum bands within the country. These guidelines, drawn from the Eswatini Communications Commission Act, 2013, and the Electronic Communications Act, 2013, serve to clarify technical standards and outline necessary compliance for users operating on specific spectrum bands without requiring a formal license.

The guidelines apply to all individuals and entities holding either an individual or general license issued by the Eswatini Communications Commission (ECC). This includes operators and electronic communication service providers, as well as users of devices that operate on license-exempt spectrum bands. Compliance with these guidelines also requires adherence to the Electronic Communications (Radio Frequency Spectrum) Regulations, 2016. 

Purpose and Scope of the Guidelines

These guidelines were created to address several objectives: 

  • Review Existing Provisions: Revisiting and updating the current standards for license-exempt spectrum usage to align with technological advances. 
  • Set Technical Standards: Providing detailed specifications for Short Range Devices (SRDs) and emerging technologies operating within these bands. 
  • Prevent Interference: Ensuring users do not experience disruptive interference, particularly in areas utilizing Broadband Fixed Wireless Access (BFWA) applications.
