Costa Rica: 5G Spectrum Bidding Process Resumes After Regulatory Modifications

The Telecommunications Superintendency (SUTEL) in Costa Rica has resumed preparations for the 5G spectrum bidding process after modifying key specifications in response to regulatory concerns. The adjustments were made following a review by the Comptroller General of the Republic, which led to a temporary suspension of the bidding process.

The modifications are set to be published soon in the Official Gazette La Gaceta. Once published, SUTEL will adjust the timelines within the revised work schedule. The organization expects to begin receiving offers from potential bidders in the last week of October, according to Cinthya Arias Leitón, President of SUTEL’s Board of Directors. 

Regulatory Concerns and Modifications

The changes addressed several objections presented by companies such as Claro, Liberty, and ICE, focusing primarily on: 

  • Spectrum concentration control policies. 
  • Application of concentration control to economic groups. 
  • Participation eligibility for national operators in the regional auction phase. 
  • Principles of non-discrimination for existing operators. 
  • Conditions for the deployment of telecommunications infrastructure. 

Regulatory Concerns and Modifications

SUTEL has fully complied with all provisions mandated by the Comptroller General, focusing mainly on clarifying and formally adjusting the tender specifications.
