The National Certification and Accreditation Administration (CNCA) of China has issued an announcement on March 17, 2025 aimed at reinforcing the management and formulation of certification rules across various sectors. This new regulation, which ensures that certification bodies align their practices with national laws and standards, is designed to foster a more standardized, transparent, and compliant certification process in China.

Scope of Application

This new set of requirements applies to certification bodies that have yet to issue their own certification rules or those that have not yet been formulated in collaboration with relevant national departments. Certification bodies must be approved and qualified in the respective field to formulate and manage these rules. 

Principles and Requirements

Certification bodies are now directly accountable for ensuring that their certification rules meet several key principles: 

  • Compliance with national laws, administrative regulations, and policies 
  • Alignment with current mandatory national and industry standards 
  • Maintenance of fairness, transparency, and public interest 
  • Restrictions on certifying areas involving sensitive topics such as national security or political matters 

Additionally, the certification rules must comply with intellectual property and confidentiality requirements. These rules also need to be clear, unambiguous, and fair, with a unified approach to market competition. 

Certification Rules Management

For certification bodies, the new guidelines outline specific management protocols to ensure rules are developed and maintained correctly: 

  • Project Justification: Each rule must be demonstrated to comply with the principles and suitability for the field it pertains to. 
  • Self-Inspection: Certification bodies are now required to establish self-inspection procedures to ensure their rules meet regulatory and compliance standards. 
  • Acceptance Review: Before implementation, an acceptance review procedure must be conducted, with external experts if necessary, to assess the viability of the rules. 
  • Effectiveness Evaluation: Regular evaluations (at least every two years) will monitor how well the rules are working in practice and their impact on the certification process. 
  • Dynamic Maintenance: Any changes in laws, regulations, or standards that affect certification rules must be incorporated promptly. If necessary, these rules will be amended or suspended. 

Filing and Reporting

Certification bodies must file the full text of their certification rules, including relevant technical specifications and standards, through the official reporting platform. Furthermore, any amendments or cancellations to these rules must be submitted to the platform within 30 days. 

These new measures also require periodic reviews and compliance checks to maintain the integrity of the certification process. If certification rules do not meet the new standards, certification bodies will face penalties.
