Brazil’s National Telecommunications Agency (Anatel) has opened Public Consultation No. 48/2025 to collect feedback on proposed technical and operational requirements for conformity assessments of Data Centers integrated into telecommunications networks (DCTCs). The consultation is open to the public, industry stakeholders, and technical experts for 70 days through the Participa Anatel platform.

New Framework for Data Centers in Telecom Networks

The proposed act supports the implementation of Resolution No. 780/2025, which officially brings data centers under Anatel’s compliance oversight. The move aims to ensure that critical digital infrastructure supporting telecom services operates with high standards of reliability, cybersecurity, and environmental sustainability.

Key Regulatory Objectives

The draft regulation outlines specific requirements for data centers deemed essential to the continuity of telecommunications services. These requirements are grouped into four main regulatory pillars:

  • Resilience and Continuity: Data centers must implement redundant systems for power, climate control, and connectivity, along with physical protections to mitigate risks from environmental disruptions.

  • Cybersecurity: Operators must adopt risk assessment frameworks aligned with international standards, specifically the ISO/IEC 27000 series, to protect data confidentiality and service integrity.

  • Sustainability and Efficiency: Operators must measure key metrics such as Power Usage Effectiveness (PUE), Water Usage Effectiveness (WUE), and Carbon Usage Effectiveness (CUE), while also implementing energy and environmental management systems.

  • Electromagnetic Compatibility (EMC): The regulation includes specific EMC criteria for facilities that use Graphics Processing Units (GPUs), critical for AI workloads.

Recognition of International Certifications

To minimize administrative burden and avoid redundant compliance costs, the proposed regulation allows operators with existing international certifications to apply for recognition directly with Anatel. Recognized standards include:

  • ISO 27001 (Information Security Management)

  • ISO 14001 (Environmental Management)

  • ISO 50001 (Energy Management)

  • TIA-942 (Data Center Telecommunications Infrastructure)

This equivalency model enables faster regulatory approval for operators that already meet global benchmarks.

Implementation Timeline and Oversight

The proposed act provides a one-year adaptation period after its official publication. During this time, data center operators are expected to align their audit processes and engage with certified System Assessment Bodies (SABs) for compliance evaluations.
