Brazil: Public Consultation Opens for Mobile Technology Requirements

Public Consultation No. 36 introduces a proposal to update the requirements for Access Terminal Stations (ETAs) and cellular mobile phones in Brazil.

The proposed changes aim to restrict the certification and approval of new equipment that only supports 3G technology or lower for use in Personal Mobile Service (SMP) networks.  

This initiative follows the analysis of feedback from Call for Subsidies No. 23/2023, which sought input on accelerating the transition from 2G and 3G technologies to 4G and 5G. The goal is to enhance the transition process for telecommunications service users. For detailed information, refer to SEI process No. 53500.088281/2023-44.

Public Consultation No. 36 Draft Act (Translated from Portuguese)

Article 1

Include new subitems numbered 4.4 and 4.5 in the Annex to Act No. 3151, of June 12, 2020, with the following wording: 

  • 4.4. Certification of modules or end products classified as Personal Mobile Service Access Terminal Stations that are compatible only with 3G or lower technologies is not permitted. 
  • 4.5. Modules or end products classified as Personal Mobile Service Access Terminal Stations with the capacity to establish voice calls must support operation with VoLTE (Voice over LTE) technology. 

Article 2

Include new subitems numbered 4.5 and 4.6 in the Annex to Act No. 3152, of June 12, 2020, with the following wording: 

  • 4.5. Certification of mobile phones compatible only with 3G or lower technologies is not permitted. 
  • 4.6. Mobile phones must support the establishment of voice calls using VoLTE (Voice over LTE) technology. 

Article 3

The approval of modules and final products compatible only with 3G or lower technologies will be authorized only to meet demands for spare parts for the automotive industry and with express authorization from Anatel’s Certification and Numbering Management (ORCN). 

Article 4

Equipment compatible only with 3G or lower technologies, approved before the entry into force of this Act, may maintain their certifications in a regular manner without needing to adjust their technical characteristics to the requirements approved by this Act. 

Article 5

This Act shall come into force 180 days after its publication.
