On August 1, 2025, Brazil’s National Telecommunications Agency (Anatel) approved significant revisions to the Regulation for Conformity Assessment and Approval of Telecommunications Products. This update, part of the 2025–2026 Regulatory Agenda, broadens the scope of compliance to include marketplaces, refurbished products, and data centers integrated into telecom networks.

Expanded List of Violations

The regulation increases the number of sanctionable violations from 5 to 12, adding new infractions related to:

  • Storage and importation of non-approved products

  • Advertising products without the required approval code

  • Use of invalid approval codes or codes belonging to other equipment

  • Marketing, offering, or presenting products under conditions other than those in the technical requirements

  • Obstruction of Anatel’s inspection and market supervision activities

These additions significantly widen enforcement powers, targeting the entire supply chain, from importers to online platforms.

Marketplace Liability in Product Approval

For the first time, digital commerce platforms, including marketplaces such as Mercado Livre, Amazon, Shopee, and Magalu, are formally recognized as part of the sales chain for telecommunications equipment. Even if these platforms only advertise products, they are now jointly liable with sellers for violations involving:

  • Offering non-approved products

  • Advertising without an Anatel approval code

  • Using false or invalid approval codes

Marketplaces must verify the regularity of products listed and ensure approval codes are displayed. This measure rejects the argument that Brazil’s Civil Rights Framework for the Internet exempts platforms from responsibility, affirming that they act as suppliers under the Consumer Protection Code.

Refurbished Equipment for Public Policy Use

The revised regulation introduces a controlled pathway for approving refurbished telecommunications products when intended for public policy initiatives, such as digital inclusion programs. Approval will require compliance with technical criteria and will be detailed in supplementary regulatory acts. Approved refurbished equipment may display a distinct Anatel identification mark to differentiate it from newly manufactured products.

Data Center Compliance Requirements

Anatel has also established a new compliance framework for data centers that are part of telecommunications networks. Before operation, these facilities must be assessed for:

  • Resilience and operational continuity

  • Physical and cybersecurity protections

  • Energy efficiency standards

  • Environmental sustainability practices

A detailed operational procedure will be issued within 240 days, and existing data centers will have three years to meet the new requirements. Only facilities with confirmed compliance will be authorized for use by telecom service providers.

Enforcement Measures and Sanctions

The revised regulation also reinforces enforcement powers by outlining specific conduct subject to sanction, including marketing non-compliant products, obstructing inspections, and committing fraud in the approval process. Both sellers and marketplaces may face administrative penalties for violations, with possible removal of certification rights for severe infractions.
