Brazil: ANATEL Tightens Rules on Certificate Renewal Process

In a recent meeting on September 24, 2024, ANATEL, Brazil’s telecommunications regulator, announced changes to the certificate renewal process. Moving forward, the agency will no longer permit the renewal of Certificates of Homologation (CoHs) that have been expired for more than 180 days (six months).

What the Change Means for Expired Certificates

Under the new guidelines, certificates that expired more than six months ago will no longer be eligible for renewal. Instead of simply renewing the expired certificates, companies will now be required to submit a new application for approval, conduct new product testing, and obtain a new ANATEL ID number. For certificates that expired within the six-month window, renewals are still possible, but only if all necessary documentation and test reports were submitted before the six-month deadline. 

Key Points from Resolution 715

ANATEL’s decision aligns with the requirements outlined in Resolution 715, originally published in 2019. The resolution emphasizes that: The Resolution 715 published in 2019 says: 

  • Certificates can be suspended or canceled if the product fails to meet updated technical standards. 
  • Certification bodies must ensure ongoing product evaluations and system maintenance after initial certification. 
  • Misuse of certification for promotional purposes or failure to maintain periodic product reviews could lead to cancellation. 

Read Section VII – On the Suspension and Cancellation of the Certificate of Conformity for the complete documentation.  Additionally, the resolution specifies that after 180 days of suspension, a certificate will be canceled if non-conformities are not addressed or if no valid justification is provided. 

Impact on New & Ongoing Projects

Manufacturers and certification bodies should take note of this shift in policy. Staying proactive about certification deadlines and ensuring all documentation is submitted in a timely manner will be critical moving forward. Failure to comply may result in additional costs and delays due to the need for new product testing and approval.

For renewal projects that were already in progress before this announcement, ANATEL is currently reviewing whether to allow their continuation. Although no formal announcement has been released, a decision is expected soon, and companies should closely monitor updates to stay informed.
