Brazil’s National Telecommunications Agency (ANATEL) launched Public Consultation No. 12/2025 to collect feedback on proposed updates to the Operational Procedure for Marking the ANATEL Homologation Identification on telecommunications products. This consultation, part of the agency’s 2025–2026 Regulatory Agenda, addresses vulnerabilities in the current marking system that have made it susceptible to counterfeiting.
The goal is to strengthen traceability and authentication of certified devices, ensuring that consumers and regulators can more effectively identify compliant products in the market.
Addressing Counterfeit Risks in the Homologation Process
Recent incidents involving the seizure and illegal sale of counterfeit ANATEL seals have raised red flags within the agency. These fraudulent practices allow unauthorized devices to circulate, undermining consumer safety and fair competition, while also complicating enforcement efforts.
The review aims to determine whether the existing marking procedure, defined under Act No. 4088 of July 31, 2020, remains appropriate, or if it requires modifications to address security gaps and new market realities.
Proposed Enhancements to the Homologation Process
To counteract fraud and strengthen control mechanisms, ANATEL is exploring several improvements for both physical and electronic markings. The agency is particularly interested in solutions that provide scalable, multi-layered verification capabilities accessible by various stakeholders, including:
Use of complex visual elements and special inks
Introduction of encrypted data and unique identification codes
Integration of QR codes linking to certification records
Adoption of electronic labeling (e-labels) where applicable
Alternatives for products with limited physical space for markings
These measures aim to offer traceable, tamper-resistant identifiers that are verifiable by consumers, retailers, enforcement agencies, and ANATEL’s own technical teams.
Scope of the Public Consultation
Stakeholders are invited to answer nine structured questions that focus on the technical feasibility, effectiveness, and cost implications of proposed updates. Specific areas under review include:
Compatibility of current labeling formats with diverse product types
Exemptions for space-constrained products and the sufficiency of existing alternatives
Security weaknesses in the current seal and proposals for fortified design
Suggested changes to electronic marking criteria and QR code standards
International benchmarks and evidence to support or question proposed changes
The agency seeks evidence-based responses that reference recognized international norms and assess the economic impact of implementing these improvements.
Submission Guidelines and Timeline
Contributions must be submitted exclusively through the Participa Anatel portal: https://apps.anatel.gov.br/ParticipaAnatel/. The consultation will remain open until 2 PM on February 4, 2026. Submissions via other channels will not be accepted unless the online system is officially declared unavailable.
