Anatel’s Board of Directors has approved a 45-day Public Consultation to review the regulatory framework for artificial intelligence (AI) use in Brazil’s telecommunications sector. The initiative follows an internal assessment that found existing regulations to be modern and non-restrictive for AI adoption.
The proposed changes do not introduce a dedicated AI regulation but clarify Anatel’s oversight powers. The amendments confirm the agency’s right to access AI-based equipment, applications, systems, training data, and other supporting elements when conducting inspections. They also authorize Anatel to apply AI and other emerging technologies in its own supervisory activities.
Cybersecurity Regulation Updates
The consultation also covers amendments to the Cybersecurity Regulation Applied to the Telecommunications Sector (Resolution No. 740/2020). The revisions aim to:
Extend the regulation’s scope to include data centers integrated into telecom networks
Require telecom providers using data centers or cloud services to contract suppliers with cybersecurity policies aligned with the regulation’s principles
Encourage the evaluation and potential adoption of emerging technologies such as AI and quantum computing, alongside identifying associated risks
All natural or legal persons involved in managing or developing telecom networks or services would be required to assess both the opportunities and security implications of these technologies.
Modernization of Bidding Regulations
Separately, Anatel has finalized amendments to the Bidding Regulation for telecommunications services and radio frequency use (Resolution No. 65/1998). Key updates include:
Introduction of electronic bidding and virtual public sessions
Alignment with newer regulatory frameworks
Inclusion of mandatory ESG (environmental, social, and governance) criteria in proposal evaluations, ensuring bidders meet defined sustainability standards
These changes were part of the 2025–2026 Regulatory Agenda and follow Public Consultation No. 40/2024.
