Argentina: New Framework for Electrical Safety Conformity

Argentina has introduced a comprehensive General Framework for Conformity Evaluation through Resolution No. 799, with the aim of simplifying certification processes and enhancing product safety measures in the marketplace. This new framework updates existing standards, particularly replacing outdated certification systems, to facilitate smoother trade operations and ensure consumer protection.

Key Objectives of the New Framework

The General Framework approved in Resolution No. 799/2024 lays out essential guidelines for ensuring that products and services marketed in Argentina comply with international and local safety standards. Key objectives include: 

  • Streamlining Bureaucratic Procedures: By repealing several older regulations such as Resolutions No. 197/2004, No. 282/2014, and No. 344/2021, the framework seeks to eliminate redundant and complex certification procedures that have historically hindered trade and raised transaction costs. 
  • Ensuring Public Safety: Products must meet the standards outlined in Law No. 24,240 and Decree No. 274/2019, ensuring they do not pose foreseeable risks to consumer health or safety. 

Certification and Compliance System

The framework introduces an integrated certification system: 

  • Mandatory Certification Symbols: Products subject to mandatory certification must display compliance symbols as per the guidelines of Resolution No. 799/1999 and the subsequent updates. This ensures transparency in verifying product safety standards. 
  • Remote Procedures (TAD Platform): Companies are now required to submit certifications and other compliance documents digitally through Argentina’s Remote Procedures (TAD) Platform, as stated in Decree No. 1,063/2016. This streamlines the certification process and minimizes delays. 

Increased focus is placed on market surveillance to ensure that products sold meet technical regulations. Suppliers are required to report potentially hazardous products under a new early warning system. The surveillance measures aim to prevent non-compliant or unsafe products from entering the market, ensuring adherence to the new framework. 

Important Amendments and Repeals

In addition to establishing new guidelines, this resolution repeals previous measures, including: 

  • Resolution No. 197/2004 related to product certification systems. 
  • Resolution No. 282/2014 and Resolution No. 344/2021, which previously regulated conformity procedures for goods and services. 

Additionally, any recognition agreements between local and international certification bodies under previous frameworks will remain valid under specific conditions, as outlined in Article 5 of Resolution No. 799/2024.
